As a researcher focused on agent architectures, I find this moment revealing—not for what it says about politics, but for what it exposes about the fundamental mismatch between how we govern AI and how AI systems actually work.

The Policy Layer Versus the Architecture Layer

Sacks’ tenure as AI czar was always going to be brief. The role itself reflects a category error: treating AI as a discrete policy domain rather than as substrate that cuts across every domain. You cannot “czar” your way through a technology that operates at the level of computational primitives.

His return to venture capital is less interesting than what his departure reveals. Policy roles in AI attract attention, but the real decisions happen in architecture meetings at labs and infrastructure companies. When you design a multi-agent system, you’re encoding governance assumptions into the interaction protocols. When you choose a particular attention mechanism, you’re making tradeoffs about what kinds of reasoning the system can perform.

These architectural choices have more lasting impact than any regulatory framework drafted in 2025.

What Congress Doesn’t Understand About Agent Systems

The proposed 10-year moratorium on state AI laws assumes AI is a thing you can draw boundaries around. But modern agent systems don’t respect jurisdictional boundaries. An agent operating in California might invoke a model hosted in Virginia, query a knowledge base in Oregon, and execute actions through APIs distributed across a dozen states.

Which state’s law applies? All of them? None of them? The question reveals the inadequacy of geographic regulation for systems that exist primarily in logical space.

More importantly, the moratorium assumes we know what we’re regulating. We don’t. The shift from single-model inference to multi-agent orchestration changes the entire threat model. An agent that can spawn sub-agents, delegate tasks, and synthesize results across multiple reasoning chains doesn’t fit neatly into frameworks designed for chatbots.

OpenAI’s o1 and the Reasoning Regime Shift

Recent coverage of OpenAI’s o1 model highlights this architectural evolution. The model uses extended chain-of-thought reasoning, essentially running an internal dialogue before producing output. This isn’t just a performance improvement—it’s a structural change in how the system operates.

From a governance perspective, this matters enormously. Traditional AI safety approaches focus on input filtering and output monitoring. But if the system is doing substantial reasoning internally, the attack surface shifts. You need to think about reasoning-time interventions, not just inference-time controls.

Sacks’ policy work couldn’t have addressed this even if he’d stayed. The relevant decisions are being made by researchers choosing between different reasoning architectures, not by officials drafting executive orders.

What Venture Capital Understands That Policy Doesn’t

Sacks returns to a world where capital allocation shapes technological trajectories more directly than regulation. VCs fund specific architectural approaches. They bet on particular agent frameworks, reasoning systems, and orchestration layers.

These funding decisions determine which agent architectures get built, which get refined, and which get deployed at scale. A well-funded team can iterate through dozens of architectural variations in the time it takes a regulatory body to schedule hearings.

This isn’t an argument against regulation. It’s an observation about where the actual degrees of freedom lie. If you want to influence how AI systems behave, you need to engage with the architectural choices being made in research labs and engineering teams.

The Real Governance Challenge

The hard problem isn’t writing AI policy. It’s developing governance mechanisms that operate at the same level of abstraction as the systems being governed. For agent architectures, this means thinking about interaction protocols, capability boundaries, and compositional safety properties.

These aren’t policy questions in the traditional sense. They’re technical design questions with policy implications. The people making these decisions aren’t czars or legislators—they’re researchers and engineers choosing between different ways to structure agent communication, different approaches to goal specification, different methods for handling uncertainty.

Sacks’ departure is a footnote. The real story is the growing gap between the policy layer and the architecture layer, and our collective failure to bridge it. Until we develop governance approaches that engage with agent systems at the level of their actual operation, we’ll keep appointing czars who can’t czar and passing laws that can’t regulate.

The architecture will continue to evolve, indifferent to our policy theater.
